When you sign up, we collect only what's needed to send your birthday greeting:

• Name: to personalize your message
• Phone number: to deliver your SMS birthday message
• Birth month and day: to know when to send it (we do not collect birth year)

2. How We Use Your Information

We use the information you provide to:

• Send you a personalized birthday text message once per year, on your registered date
• Send a one-time confirmation message when you sign up or opt out
• Include a gift certificate link in your birthday message
• Maintain and improve the Service, and respond to support requests
• Comply with legal obligations

We do not sell or rent your personal information. We share information only in these limited circumstances:

• Service providers: We use Twilio, our SMS delivery provider, solely to transmit your birthday message. Twilio processes your phone number and message content on our behalf and is contractually restricted from using it for its own purposes.
• Legal requirements: If required by law, subpoena, or other legal process.
• Business transfers: If EatCake.Day is involved in a merger, acquisition, or asset sale, your information may transfer to the successor entity, subject to this Policy.

As stated above, none of this sharing extends to using your SMS opt-in consent for a third party's marketing purposes.

Your information is stored in a private data file used only by our sign-up and messaging system, and is not publicly accessible. We take reasonable technical measures to protect it, though no method of electronic storage is completely secure.

We retain your information for as long as you remain signed up to receive birthday messages. If you opt out or ask us to delete your data, we will remove it promptly.

8. SMS Messaging Details

By providing your phone number, you consent to receive recurring automated SMS messages from EatCake.Day (one per year, on your birthday, plus a confirmation message at sign-up and at opt-out). Message and data rates may apply. Reply STOP to cancel at any time, or HELP for assistance. Carriers are not liable for delayed or undelivered messages.

9. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect information from anyone under 13. If we learn we have done so, we will delete it promptly.

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date.
